2. Acceptance of Terms

By accessing and using the Cerruti.com website and placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Sale, along with our Privacy Policy.

These terms constitute a legally binding agreement between you (the "Customer" or "you") and CERRUTI operating as CERRUTI1881.COM (the "Company," "we," "us," or "our").

If you do not agree with these terms, please do not use our website or place orders.


3. Definitions

"Customer" or "you": Any individual or entity placing an order on the Cerruti.com website.

"Product(s)": Fashion accessories including writing instruments, watches, jewelry, small leather goods, and gifting accessories offered for sale on our website.

"Order": A purchase request submitted by a Customer through our website.

"Website": The e-commerce platform accessible at www.loxor.io and associated subdomains.

"Business Day": Monday through Friday, excluding public holidays in Europe.

"EU": European Union member states.


4. Eligibility and Age Requirements

4.1 Age Restriction

You must be at least 18 years old to purchase products from Cerruti.com. By placing an order, you confirm that you meet this age requirement.

4.2 Minors

Any purchases made by individuals under 18 years old must be made with the explicit knowledge, consent, and supervision of a parent or legal guardian. Parents and guardians are fully responsible for purchases made by minors under their supervision.

4.3 Legal Capacity

You confirm that you have the legal capacity to enter into binding contracts under the laws of your jurisdiction.


5. Product Information

5.1 Product Descriptions

We make every effort to provide accurate product descriptions, specifications, and images on our website. However:

  • Product images are for illustrative purposes and may vary slightly from actual items in terms of color, size, or appearance due to photography and screen display settings
  • Product specifications are provided by manufacturers and are subject to change without notice
  • Dimensions, weights, and other measurements are approximate
  • All products include original brand packaging unless otherwise stated

5.2 Product Authenticity Guarantee

CERRUTI1881 guarantees that all products sold are 100% authentic and sourced from authorized distributors and brand partners.

  • All items include original manufacturer packaging
  • For products valued at €500 or more (such as luxury watches and jewelry), a certificate of authenticity will be provided where applicable
  • If you receive a non-authentic product, we offer a full refund with no questions asked

5.3 Product Availability

Product availability is subject to stock levels. While we strive to maintain accurate inventory information in real-time:

  • A product displayed as "in stock" may become unavailable if multiple customers purchase simultaneously
  • If an ordered item becomes unavailable after order confirmation, we will notify you immediately by email
  • You will have the option to choose an alternative product or receive a full refund
  • Refunds for unavailable items will be processed within 5 business days

5.4 Product Suitability

Products sold on Cerruti.com are intended for personal use and may not be resold for commercial purposes without our authorization.


6. Prices and Payment

6.1 Prices

All prices displayed on our website are in Euros (€) and include the applicable Value Added Tax (VAT).

VAT Application:

  • We operate under the EU One-Stop Shop (OSS) scheme
  • VAT rates vary by destination country and will be automatically calculated at checkout based on your delivery address
  • The final price you see at checkout includes all applicable taxes for your country
  • No additional taxes or customs duties will apply for deliveries within our service area

Price Accuracy:

  • Prices are subject to change at any time without prior notice
  • The price applicable to your order is the price displayed at the time you complete your purchase (click "Confirm Payment")
  • Confirmed orders will not be affected by subsequent price changes

6.2 Obvious Pricing Errors

In the event of an obvious pricing error (e.g., a €500 watch listed at €5 due to a technical error):

  • We reserve the right to cancel the order and notify you immediately
  • You will be offered the option to purchase the product at the correct price or receive a full refund
  • No order is binding until we send you an order confirmation email

6.3 Payment Methods

We accept the following payment methods:

a) Shopify Payments (powered by Stripe)

  • Credit and debit cards: Visa, Mastercard, American Express, and other cards supported by Stripe
  • Your payment information is transmitted directly to Stripe using secure encryption
  • We do not store your complete credit card information

  • Available for orders of €80 or more
  • Payment options: "Pay in 30 days" or "Pay in 3 interest-free installments"
  • Must be 18 years or older to use Klarna
  • Subject to Klarna's credit assessment and approval
  • Klarna may perform credit checks to assess eligibility

  • Your agreement with Klarna is separate from your purchase agreement with Cerruti.com

Important: All payment information is processed securely through PCI-DSS compliant payment providers. We never store your complete payment card details.

6.4 Payment Processing and Authorization

  • Payment is authorized and captured at the time you complete your order
  • Your bank or card issuer may place a temporary hold on your account
  • If an item becomes unavailable after payment, you will receive a full refund automatically

6.5 Payment Security and Fraud Prevention

We implement security measures to protect against fraudulent transactions. As part of our verification process:

  • We may request additional documentation to verify your identity or payment method
  • Documents may include: proof of identity (ID card, passport), proof of address, or proof of payment method ownership
  • Requests will be made by email to the address provided during checkout
  • You must provide requested documents within 8 business days
  • Failure to provide documentation may result in order cancellation and refund

We reserve the right to refuse or cancel orders from customers who have:

  • Previously failed to pay for orders
  • Engaged in fraudulent activity
  • Violated our Terms and Conditions
  • Outstanding payment disputes with Cerruti.com

6.6 Promotional Codes and Discounts

  • Only one promotional or discount code can be applied per order
  • Promotional codes cannot be combined with other codes unless explicitly stated
  • Codes are valid for the period specified in the promotional campaign
  • Codes may be subject to minimum purchase requirements or product exclusions
  • Codes cannot be redeemed for cash
  • We reserve the right to refuse or cancel orders that abuse promotional offers

7. Order Process

7.1 Placing an Order

To place an order:

  1. Browse products and add desired items to your shopping cart
  2. Review your cart and click "Checkout" when ready
  3. Provide your email address and delivery information
  4. Select your shipping method and review shipping costs
  5. Review your complete order summary, including all costs
  6. Choose your payment method
  7. Confirm your order by clicking "Complete Payment" or equivalent

7.2 Order Confirmation

Once your payment is successfully processed:

  • You will see an on-screen order confirmation
  • An order confirmation email will be sent to the email address you provided
  • This email constitutes our acceptance of your order and forms a binding contract
  • The confirmation email will include your order number, items ordered, total price, delivery address, and estimated delivery timeframe

Important: If you do not receive a confirmation email within 24 hours, please check your spam/junk folder and contact us at support@loxor.io.

7.3 Order Modifications and Cancellations

Before Shipment:

  • You may request order modifications or cancellations within 2 hours of order placement by contacting support@loxor.io
  • Modifications include: changing delivery address, adding or removing items, or canceling the entire order
  • Once a shipping label has been created, modifications are no longer possible

After Shipment:

  • Orders cannot be modified once shipped
  • You may refuse delivery or return items according to our Returns Policy (Section 9)

7.4 Order Tracking

Once your order is shipped:

  • You will receive a shipping confirmation email with a tracking number
  • You can track your package in real-time through the carrier's website (link provided in email)
  • Tracking information may take 24 hours to become active after shipment

7.5 Account Creation

  • Guest Checkout is available - account creation is optional
  • Creating an account allows you to:
    • Track orders easily
    • View order history
    • Save delivery addresses for faster checkout
    • Manage returns
    • Receive exclusive offers and updates (with your consent)

8. Shipping and Delivery

8.1 Delivery Area

We deliver to the following countries:

Europe:

  • Belgium, Netherlands, Luxembourg (Benelux)
  • France (Metropolitan)
  • Germany
  • Austria
  • Denmark
  • Italy
  • Spain

We do not currently ship to:

  • Countries outside the above list
  • PO Boxes (physical addresses only)
  • Military bases or APO/FPO addresses

8.2 Shipping Costs

Important Notes:

  • Shipping costs are calculated based on the order total before any discounts or promotional codes
  • If you return items and your remaining order value falls below €69, the €4.99 shipping fee will be deducted from your refund (see Section 9.6)

8.3 Processing and Delivery Times

Processing Time: 1-3 business days

  • This is the time needed to prepare and pack your order before shipment
  • Processing begins after payment confirmation

Delivery Time: 2-4 business days (after shipment)

  • Delivery times are estimates and may vary by location and carrier
  • Some orders may arrive faster depending on the fulfillment center location

Total Time from Order to Delivery: Typically 3-7 business days

Delays: Delivery times may be extended during:

  • Peak shopping periods (Black Friday, Christmas, sales)
  • Public holidays
  • Adverse weather conditions
  • Circumstances beyond our control

8.4 Fulfillment Centers

Orders may be fulfilled from different locations:

  • CERRUTI1881 warehouses (Asia/Europe)
  • Amazon Multi-Channel Fulfillment (MCF) centers

You will not be informed which center fulfills your order, but all orders are subject to the same quality standards and delivery commitments.

8.5 Delivery Methods

We use trusted shipping carriers including:

  • DPD
  • Colissimo
  • Amazon Logistics (for MCF orders)
  • Other local carriers as appropriate

Deliveries are made:

  • Monday to Friday during standard business hours
  • To the address provided during checkout
  • Signature may be required upon delivery

8.6 Failed Delivery Attempts

If the carrier is unable to deliver your package:

  • A delivery notice will be left in your mailbox
  • The package will be held at a local pickup point or post office
  • You will have 14 days to collect your package
  • After 14 days, the package will be returned to us
  • Return shipping costs (€4.99) will be deducted from your refund if the failed delivery was due to incorrect address information or your unavailability

8.7 Damaged or Lost Packages

Damaged in Transit:

  • If your package arrives visibly damaged, you should:
    1. Note the damage on the carrier's delivery receipt before or upon acceptance
    2. Take photos of the damaged packaging and product
    3. Contact us immediately at support@loxor.io within 48 hours
  • We will arrange for a replacement or full refund at no cost to you

Lost Packages:

  • If your package shows as "delivered" but you have not received it:
    1. Check with neighbors or building management
    2. Verify the delivery address in your order confirmation
    3. Contact us at ecommerce@cerruti.com within 5 business days
  • We will open an investigation with the carrier and provide a replacement or refund if the package cannot be located

8.8 Incorrect or Incomplete Orders

If you receive the wrong item or your order is incomplete:

  • Contact us at ecommerce@cerruti.com within 48 hours of delivery
  • Provide your order number and photos of the received items
  • We will arrange for return shipping (at our cost) and send the correct items or provide a refund

8.9 Delivery Address Responsibility

You are responsible for providing a complete and accurate delivery address. We are not liable for:

  • Delays or failed deliveries due to incorrect or incomplete address information
  • Packages delivered to the address you specified, even if that address was incorrect
  • Additional costs incurred to reroute or redeliver packages due to address errors

9. Returns and Refunds

9.1 Your Right of Withdrawal (EU Consumer Law)

As an EU consumer, you have a legal right to withdraw from your purchase within 14 days without giving any reason. This right begins on the day you (or a third party you designate, other than the carrier) receive the goods.

At CERRUTI1881, we extend this to 30 days for your convenience.

9.2 30-Day Return Policy

You may return products for a refund or exchange within 30 days of delivery for any reason, subject to the conditions below.

This 30-day period is voluntary on our part and exceeds the legal 14-day EU withdrawal period.

9.3 Return Conditions

To be eligible for a return, items must meet the following conditions:

General Requirements:

  • Products must be unworn, unused, and in their original condition
  • All original tags, labels, and packaging must be intact
  • Products must be accompanied by all accessories, manuals, and certificates that were included
  • Items must not show signs of use, wear, or damage
  • You may try on items at home (e.g., fitting a watch or ring) but must not wear them outside or use them

Non-Returnable Items: The following items cannot be returned for hygiene, safety, or customization reasons:

  • Pierced earrings (if packaging seal is broken)
  • Personalized or engraved products
  • Items marked as "Final Sale" or "Non-Returnable" at the time of purchase
  • Products without original tags or in damaged/incomplete condition

Exception for Defective or Incorrect Items: If you received a defective, damaged, or incorrect product, standard return conditions do not apply (see Section 9.9).

9.4 How to Initiate a Return

Step 1: Request a Return

  • Log into your account at www.cerruti1881.com and go to "My Orders"
  • Select the order containing items you wish to return
  • Click "Request Return" and follow the instructions

OR

  • Email ecommerce@cerruti.com with:
    • Your order number
    • The item(s) you wish to return
    • Reason for return (optional but helps us improve)

Step 2: Receive Return Instructions

  • We will email you a prepaid return shipping label within 24 hours (business days)
  • Print the return label or show the digital label at the carrier location (if applicable)

Step 3: Pack Your Return

  • Place items in their original packaging if possible
  • Ensure all tags, accessories, and documentation are included
  • Attach the return label to the outside of the package

Step 4: Ship Your Return

  • Drop off the package at the designated carrier location (instructions in return email)
  • Keep your receipt as proof of return shipment

9.5 Return Shipping Costs

Standard Returns (Change of Mind):

  • Return shipping is FREE for all standard returns within 30 days
  • We provide a prepaid return label for your convenience
  • You do not need to pay for return shipping

Defective, Damaged, or Incorrect Products:

  • Return shipping is always FREE (see Section 9.9)

9.6 Refund Process and Timing

Inspection:

  • Once we receive your return, we will inspect the items within 3 business days
  • Items must meet the return conditions outlined in Section 9.3

Refund Approval:

  • If approved, your refund will be processed within 14 days of receiving the returned item (in compliance with EU law)
  • You will receive an email confirmation once the refund is issued

Refund Method:

  • Refunds are issued to the original payment method used for the purchase
  • Credit/Debit Card: Refunds appear in 5-10 business days depending on your bank
  • PayPal: Refunds appear in your PayPal account within 3-5 business days
  • Klarna: Your payment plan will be adjusted; contact Klarna for specific timing

Refund Amount:

  • You will receive a refund for the product price paid
  • Shipping fee deduction: If your original order qualified for free shipping (€69+) but the returned items bring your order total below €69, we will deduct €4.99 from your refund

Example:

  • Original order: €80 (free shipping)
  • You return: €30 worth of items
  • Remaining order value: €50
  • Refund: €30 - €4.99 = €25.01

Non-Refundable:

  • Original shipping fees (if you paid shipping) are non-refundable unless the return is due to our error or a defective product

Rejected Returns:

  • If returned items do not meet our return conditions (damaged, worn, missing tags), we will notify you by email
  • You may choose to have the items returned to you at your expense or forfeit the items
  • No refund will be issued for rejected returns

9.7 Exchanges

We do not offer direct product exchanges. If you wish to exchange an item:

  1. Return the original item for a refund (following the process above)
  2. Place a new order for the desired item

This ensures you receive your new item as quickly as possible without waiting for the return to be processed.

9.8 Late or Missing Refunds

If you have not received your refund within the expected timeframe:

  1. Check your bank account or payment method again
  2. Contact your bank or credit card company - processing times vary
  3. Contact your payment provider (PayPal, Klarna)
  4. If you've done all of this and still have not received your refund, contact us at ecommerce@cerruti.com

9.9 Defective, Damaged, or Incorrect Products

If you received a defective, damaged, or incorrect product:

Your Rights:

  • You have 2 years from delivery to report defects (EU legal guarantee - see Section 10)
  • Report obvious defects within 48 hours of delivery for fastest resolution
  • We will cover all return shipping costs
  • You may choose between a replacement (if available) or full refund, including original shipping costs

Process:

  1. Contact ecommerce@cerruti.com immediately with:
    • Your order number
    • Description of the defect or issue
    • Photos of the product and defect (if applicable)
  2. We will provide a prepaid return label at no cost to you
  3. Once received, we will send a replacement or issue a full refund within 5 business days

Note: This does not affect your statutory rights under the EU legal guarantee (Section 10).

9.10 Gift Returns

If you received a product as a gift:

  • Returns are accepted within 30 days of the original delivery date
  • Refunds will be issued as store credit since you did not make the original payment
  • Store credit can be used for future purchases on CERRUTI1881

10. Warranty and Legal Guarantee

10.1 EU Legal Guarantee (2 Years)

Under EU consumer law, all products sold by CERRUTI1881 come with a 2-year legal guarantee starting from the date of delivery.

This guarantee covers:

  • Products that are defective or not as described
  • Products that develop faults due to manufacturing defects
  • Products that do not meet quality standards expected for that type of product

During the first 12 months:

  • Any defect is presumed to have existed at the time of delivery (unless we can prove otherwise)
  • We are responsible for repair, replacement, price reduction, or refund

After 12 months (months 13-24):

  • You may need to prove that the defect existed at the time of delivery
  • We remain responsible for manufacturing defects

This guarantee does NOT cover:

  • Normal wear and tear from regular use
  • Damage caused by misuse, accidents, or negligence
  • Damage from failure to follow care instructions
  • Unauthorized repairs or modifications
  • Consumable parts (e.g., watch batteries) unless defective from the start

How to Make a Claim: Contact ecommerce@cerruti.com with:

  • Your order number
  • Description of the defect
  • Photos or videos demonstrating the issue
  • Proof of purchase (order confirmation email)

We will assess your claim and provide a remedy within a reasonable time at no cost to you.

10.2 Manufacturer's Warranty (Extended)

Many of our products (especially watches and luxury items) come with additional manufacturer's warranties that extend beyond the 2-year legal guarantee.

Manufacturer Warranty Details:

  • Duration and coverage vary by brand and product
  • Warranty documentation is included with the product
  • You may need to register your product directly with the manufacturer
  • Claims are typically handled directly with the manufacturer's service center

CERRUTI's Role:

  • We will assist you in facilitating warranty claims during the first 2 years
  • After 2 years, warranty claims should be directed to the manufacturer
  • We can provide proof of purchase and warranty documentation if needed

10.3 Limitation of Warranties

The warranties described above are the only warranties we provide. We disclaim all other warranties, express or implied, to the fullest extent permitted by law, including but not limited to implied warranties of merchantability and fitness for a particular purpose.


11. Ownership and Risk

11.1 Transfer of Risk

The risk of loss or damage to products passes to you upon delivery. Once the carrier delivers the product to your specified address:

  • You are responsible for the product's safekeeping
  • Any loss or damage after delivery is your responsibility
  • Ensure someone is available to receive the package or authorize safe placement

11.2 Retention of Title

Products remain the property of Cerruti.com until full payment has been received.

However, for payment methods where payment is completed at checkout (Shopify Payments, PayPal), ownership transfers upon delivery.

For Klarna purchases, once Klarna confirms payment to us, ownership transfers upon delivery. Your ongoing payment obligation is to Klarna, not Cerruti.com.


12. Limitation of Liability

12.1 Scope of Our Liability

To the fullest extent permitted by law, Cerruti.com's liability is limited as follows:

We ARE liable for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Breach of the legal guarantee (Section 10.1)
  • Any liability that cannot be excluded or limited under EU consumer protection law

We ARE NOT liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, business, or anticipated savings
  • Loss of data or information
  • Business interruption or loss of business opportunity
  • Any damages arising from your use or inability to use the website or products beyond the purchase price of the product

12.2 Website Availability and Accuracy

While we strive to ensure our website is available and accurate:

  • We do not guarantee uninterrupted or error-free website operation
  • We may suspend or restrict access for maintenance, updates, or security reasons
  • We are not liable for technical issues, server downtime, or connectivity problems beyond our control
  • Information on the website is provided "as is" without warranties regarding accuracy or completeness

12.3 Your Responsibility

You are responsible for:

  • Ensuring your device has adequate security software (antivirus, firewall)
  • Protecting your account credentials and preventing unauthorized access
  • Reviewing your orders carefully before confirming purchase
  • Providing accurate information (email, delivery address, payment details)

13. Force Majeure

We are not liable for any failure to perform or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, storms, natural disasters)
  • War, terrorism, civil unrest, or riots
  • Pandemics, epidemics, or public health emergencies
  • Government actions, laws, or regulations (including lockdowns or trade restrictions)
  • Labor disputes or strikes (including those affecting our suppliers, carriers, or service providers)
  • Failure of telecommunications, internet, or power infrastructure
  • Cyberattacks, hacking, or data breaches affecting our systems or service providers
  • Fire, explosion, or accidents
  • Supply chain disruptions or shortages

In the event of force majeure:

  • We will notify you as soon as reasonably practicable
  • We will make reasonable efforts to minimize the impact and resume normal operations
  • Our obligations will be suspended for the duration of the force majeure event
  • If the delay exceeds 30 days, you may cancel your order and receive a full refund

14. Intellectual Property Rights

14.1 Ownership

All intellectual property rights in the Cerruti.com website and its content belong to DISTRI-BRANDS S.A. or our licensors, including but not limited to:

  • Website design, layout, structure, and presentation
  • Name, logo, and branding elements

14.2 Restrictions

You may not, without our prior written permission:
